In these terms and conditions the following words shall have the meanings set out below:
“Client” is the student who receives online coaching in case the student is 18 years or older. If the student is a minor, the client is the parent or guardian who is acting on behalf of the student.
“Coach” is the person who delivers the online coaching.
“Contract” means any contract for the purchase of online coaching sessions made between the client and Mario Ausseloos Coaching.
“Session” means an online coaching session. This could be a private session (one student) or a group session (attended by multiple students).
“Student” is the person who receives online coaching.

These Terms and Conditions govern the provision of mathematics coaching services offered by Mario Ausseloos Coaching. All coaching sessions are conducted online and are specifically tailored to meet the individual learning needs and goals of each student. The services include both private one-on-one sessions and group sessions, available to students aged 16 and above. By engaging in the services of Mario Ausseloos Coaching, clients agree to these terms and conditions, which may be updated from time to time.

3.1 Prospective clients
Prospective clients are encouraged to book a complimentary consultation to discuss their (or their child’s) academic goals and aspirations in detail before commencing coaching services. This initial meeting can be easily booked and scheduled through the website www.marioausseloos.com.
The consultation should be attended by the student seeking mathematics coaching, and if the student is a minor, they must be accompanied by a parent or guardian. Our scheduling tool allows for the addition of guests, making it convenient for multiple individuals to attend the consultation.
Students interested in being coached together are strongly advised to book separate consultation meetings for each individual, ensuring ample time to discuss their unique academic goals and needs.
3.2 Coaching sessions
The scheduling of coaching sessions will be agreed upon mutually by the coach and client/student, based on their respective availability. Any rescheduling of sessions must follow the procedures and restrictions outlined in the coaching contract. Clients are encouraged to review these terms to understand the rescheduling process and any limitations that may apply.
3.3 Returning clients
Existing clients who have already had a consultation meeting within the current academic year and wish to purchase additional coaching sessions may do so by simply sending an email outlining their requirements.
Returning clients who wish to purchase coaching services in a new academic year are strongly advised to schedule a new consultation meeting. This will allow for a thorough discussion of their (or their child’s) updated academic goals and aspirations, as well as the available coaching services for the new academic period.

4.1 Minimum technical requirements
To ensure a smooth and effective online coaching experience, the client is responsible for meeting the following minimum technical requirements:
Laptop or Computer: A laptop or desktop computer equipped with a functioning microphone and webcam for communication during sessions.
Internet Connection: A stable and reliable internet connection that supports video conferencing without interruptions.
Calculator: A scientific or graphing calculator to assist with complex calculations during sessions.
The client is responsible for ensuring that these technical requirements are met prior to each session. Any disruptions or delays caused by technical issues on the client’s side may result in the session being rescheduled at the coach’s discretion.
4.2 Recommended technical requirements
While the above requirements are essential, the following are recommended for an enhanced learning experience, though not mandatory:
Tablet and Stylus: A tablet (e.g., iPad) paired with a stylus for a more interactive, hands-on learning experience, especially during problem-solving.
Headset: A headset with a microphone to ensure clear audio communication and minimise background noise during sessions.

If the student is late to a scheduled session, the session will still end at the agreed-upon time, and no additional time will be provided to compensate for the delay.
If the coach is late to a session, they will make reasonable efforts to ensure the student receives the full session time by either extending the current session or a future session, depending on the availability of all parties, or by rescheduling the affected session. However, the coach cannot guarantee the availability of specific times for rescheduling.

The coach provides online mathematics coaching services to support the student’s learning and academic progress. However, the client acknowledges that the coach is not responsible for the student’s ultimate performance, including but not limited to exam results, grades, or academic outcomes. The coaching services are intended to assist in skill development, but the student’s success depends on their own efforts, commitment, and application of the material.
The coach will not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of the coaching services. This includes, but is not limited to, any issues related to:
Internet connectivity
Software malfunctions
Platform outages or technical problems beyond the coach’s control
In the event of technical malfunctions, the coach will make reasonable efforts to reschedule affected sessions but cannot guarantee the availability of specific times. The coach’s liability, in any case, is limited to the cost of the affected session, and no further compensation will be provided for any disruption or technical issues.

All materials provided by the coach during the course of the coaching sessions, including but not limited to worksheets, notes, problem sets, and other instructional content, are the intellectual property of the coach. These materials are made available solely for the student’s personal, non-commercial use as part of the coaching services.
Students are not permitted to copy, distribute, share, modify, or otherwise use the materials for any purpose other than personal educational use. Any unauthorised sharing, reproduction, or redistribution of these materials by the client/student without the prior written consent of the coach is strictly prohibited and may result in termination of the coaching services.
By using the coaching services, the client/student agrees to respect the intellectual property rights of the coach and adhere to these restrictions.

The coach is committed to protecting the privacy and confidentiality of all client/student information. Any personal data provided by the client/student, including names, contact information, and any other details shared during the coaching process, will be used solely for the purpose of delivering the coaching services. This data will not be shared with any third parties without the client’s express consent, except as required by law.
All client/student data will be securely stored in compliance with applicable data protection laws, such as the General Data Protection Regulation (GDPR) or relevant national legislation. Reasonable measures will be taken to protect client/student data from unauthorised access, disclosure, or misuse.
No coaching session will be recorded without the prior written consent of the client. If recording is agreed upon, the recording will be used only for the purposes specified at the time of consent and will be stored securely in line with data protection requirements.
By using the coaching services, the client agrees to the collection and use of their (or their child’s) data as outlined in this clause.

The coach reserves the right to modify or update the services, including changes to fees, policies, or the Terms and Conditions at any time. Any significant changes will be communicated to clients with at least 14 days advance notice. Continued use of the coaching services after such notice constitutes acceptance of the revised terms. Clients who do not agree with the updated terms have the option to terminate the agreement before the changes take effect.

The client agrees to indemnify, defend, and hold harmless the coach from and against any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, legal fees) arising out of or related to the student’s use of the coaching services provided by the coach. This includes, but is not limited to, any actions or decisions made by the client/student as a result of the coaching sessions. The coach will not be held responsible for any outcomes or consequences, whether academic, personal, or otherwise, resulting from the student’s participation in the coaching services.

In the event of a dispute arising out of or relating to these terms and conditions, the parties agree to attempt to resolve the dispute through negotiation or mediation before pursuing other legal remedies.

These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
